These Terms of Use (the "Agreement") govern your use of our website, https://www.trajecutive.com (the "Site"), and all related services, including assessments, quizzes, workbooks, educational materials, and other tools (collectively, the "Services"). By accessing or using the Site or Services, you agree to be bound by this Agreement, including our Privacy Policy [here], which is

incorporated by reference. Please read this Agreement carefully. If you do not agree with these terms, do not use the Site or Services.

 

II. Changes to the Agreement

We may modify this Agreement from time to time. If we make material changes, we will notify you by posting the revised Agreement on the Site and updating the "Last Updated" date above. For existing users, changes will take effect 30 days after they are posted. Your continued use of the Site or Services after the 30-day notice period constitutes your acceptance of the changes. For new users, the revised terms are effective immediately.

 

III. Grant of Limited License and Use Rights

Subject to your compliance with this Agreement, Trajecutive® grants you a non-exclusive, non-transferable, revocable license to access and use the Site and Services for personal, non-commercial purposes. You may access the Site and Services only on devices you own or control and as permitted by applicable

platform providers. This license does not permit you to do any of the following:

• Copy, modify, or create derivative works of the Site or Services.
• Reverse-engineer, decompile, or disassemble any part of the Site or Services.
• Remove or alter any proprietary notices from the Site or Services.
• Use the Site or Services in any unlawful manner or in violation of this Agreement.

IV. Intellectual Property Ownership

All content and materials on the Site and Services, including text, graphics, logos, and software, are the  property of Trajecutive® or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, distribute, or display any content from the Site without our express written permission.

 

Trajecutive®'s trademarks, including "Trajecutive®";, My Worksona®, Own Your Trajectory®, Faith Your Faith®, and "Get Off Your Stationary Bike®," are owned by Intersection Faith Life Work®. Use of our trademarks without prior written consent is strictly prohibited.

 

V. Account Registration and Fees

A. Registration Information To use certain features of the Services, you may be required to create an account ("User Account") and

provide personal information as described in our Privacy Policy. You agree to provide accurate and current information and to update it as necessary. Impersonation or providing false information is prohibited.

 

B. Account Responsibility

You are responsible for maintaining the confidentiality of your User Account credentials and for all activities that occur under your account. If you suspect unauthorized use of your account, you must notify us immediately at info@ownyourtrajectory.com. We are not liable for any loss or damage arising from

unauthorized use of your account.

 

C. Fees

Trajecutive® charges fees for certain Services. These fees are non-refundable unless otherwise specified. By signing up for these Services, you agree to pay the fees as described on the Site or in your Service agreement.

 

VI. Disclaimer of Warranty and Limitation of Liability

The Site and Services are provided on an "AS IS" and "AS AVAILABLE" basis. Trajecutive® disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.  We do not guarantee that the Site or Services will be uninterrupted, error-free, or secure. Trajecutive® is not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Site or Services, even if advised of the possibility of such damages. Some jurisdictions do not allow the  exclusion of certain warranties or limitations on liability, so these exclusions or limitations may not apply to you.

 

VII. Indemnification

You agree to indemnify, defend, and hold harmless Trajecutive®, its affiliates, subsidiaries, officers, directors, agents, and employees from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Site or Services, your violation of this

Agreement, or your violation of any third party rights.

 

VIII. User Generated Content and Information

The Site may include interactive areas where users can post content ("User Generated Content"). By submitting User Generated Content, you grant Trajecutive® a worldwide, non-exclusive, royalty-free, irrevocable license to use, display, and distribute your content. You represent and warrant that you own or have the right to submit the User Generated Content and that it does not violate any laws or infringe the rights of others. You agree to indemnify Trajecutive® for any claims resulting from your User Generated Content.

 

IX. Rules of Conduct

You agree not to use the Site or Services to post or transmit any material that is:

•  Offensive, defamatory, or illegal.
•  Spam or unsolicited commercial content.
•  Harmful, abusive, or invasive of others' privacy.
•  Encouraging conduct that would constitute a criminal offense or violate any laws.

Trajecutive® reserves the right to remove any User Generated Content that violates these rules or is otherwise inappropriate, at our sole discretion.

 

X. Responsibility for Minors

If you allow a minor to use the Site or Services, you are responsible for their conduct and for ensuring they understand and comply with this Agreement. Certain content may not be appropriate for minors.

 

XI. Third-Party Websites

The Site may include links to third-party websites. Trajecutive® does not control these sites and is not responsible for their content or practices. Your use of third-party sites is at your own risk and subject to their terms of use and privacy policies.

 

XII. Suspension or Termination of Access

Trajecutive® reserves the right to suspend or terminate your access to the Site or Services at any time, for any reason, without notice. Your breach of this Agreement may result in immediate termination of your User Account.

 

XIII. Dispute Resolution and Arbitration

All disputes arising out of or related to this Agreement or the Site and Services will be resolved through binding arbitration, except for disputes related to Trajecutive®'s intellectual property rights. Arbitration will be conducted in Tampa, Florida, under the rules of the American Arbitration Association. Each party will bear its own costs of arbitration.

 

XIV. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

 

XV. Waiver

Our failure to enforce any right or provision of this Agreement does not constitute a waiver of that right or

provision.

XVII. Entire Agreement

This Agreement constitutes the entire understanding between you and Trajecutive® regarding your use of the Site and Services. Any changes to this Agreement must be made in writing and signed by both parties.
